In the years since posting information regarding the criminal exploits of Washington’s notorious Yves Julian Cauvin, I have received several emails from people that have been told there was, or were, pending charges (police reports) against me for actions I participated in as a Realtor. Anyone making such a claim is an idiot, and simply doesn't have the facts.
Mr. Cauvin has claimed I’m a fugitive from justice, and fleeing prosecution (among other things) for several crimes. He has also shown a pattern of harassment towards his victims, as well as the late Ron Belec, a Seattle based private investigator.
As a result of Cauvin's actions, the District Attorneys Office was kind enough to send out these emails (below) to dispel Cauvin’s claims and set the record straight many years ago. I refrained from posting the emails on this site for several years, but since he has continued to make the claims, and posted such claims on sites like rippoffreport.com, I really have no choice but to make the details known.
First and most importantly, I should clarify that Mr. Cauvin is by far the most pathetic and despicable person I have ever had the misfortune of encountering; I feel an obligation to expose his past, and will continue to do so for the foreseeable future.
Mortgage fraud is one of the primary factors that lead to the market collapse in 2008; and those that engaged in it needed to be brought to justice. Cauvins criminal history is incredible to say the least, and spans some 20 years or more; he was only recently released from prison after a money laundering conviction.
As the public records show, he has a long history of mental illness, violence against women, as well as financial crimes against women. To me, there is no lower life form than that which raises a hand against women or children.
In 2009 I was asked to testify against Mr. Cauvin, and I said I would; he didn't like that. In 2008 while he was incarcerated, his home was forclosed on. Mr. Cauvins then assistant Marcia Smith wanted to remove his homes contents prior to the auction, or they would in fact become part of the auction and sold with the house. She was trying to help him, and he had given her written power of Attorney notorized by Sky Benson, an associate of his.
That Power of Attorney enabled her to determine what to do with the property; some of it was stored at her condo, and some in my garage (I was her and his agent at the time). When Cauvin learned I was slated to testify against him on behalf of Ms. Smith, he falsely claimed we had stolen the items.
Since his assistant was in fact one of his victims in a straw mortgage lending scam and the primary witness against him (none of which was realized until months after the items were put in storage), he sought to discredit both of us with the false allegations.
Neither of us were ever charged or arrested for this; never even asked to go to a police station or DA's office over it, and never asked to write out a statement. The simple fact was, the power of attorney he granted her gave her every right to remove the items from the home. All items were properly stored and returned in the condition they were removed from the home in.
Any claims that my real estate or notary license was revoked is pure fantasy; I did not renew them as I was working overseas and had no need for them thus the cost of maintaining them was unjustified. No complaints have ever been filed against me with any governing body of the real estate industry, and I can obtain a license any time I so desire.
In 2014, upon his release from prison, Mr. Cauvin attempted to sue Ms. Smith and me; the case was thrown out by the Judge on the first day.
Anyone found to be spreading slander in regards to this sequence of events may very well find themselves in civil court.
Thank you, Michael W. Creel Editor
CIVIL CASES FILED BY CAUVIN AND DISMISSED BY JUDGE
From: Seaver, David Sent: Tuesday, December 23, 2008 8:20 AM Subject: Michael Creel
Dear XXXXXXXX:
I am writing in response to an e-mail I recently received from Michael Creel concerning an assertion made against him to XXXXXX.
I have reason to believe that the assertion was made by an individual I am currently prosecuting for felony theft named Julian Cauvin. The charges against Cauvin are proceeding in King County Superior Court, in Seattle, Washington.
Cauvin has demonstrated a pattern of attempting to harass witnesses that the State intends to call against him, and I believe that he may be behind the latest effort involving Mr. Creel.
Mr. Creel is not under investigation by the Bellevue, Washington, police department. That agency received a complaint from Cauvin, and determined it to be baseless.
If you have any questions, please feel free to contact me directly any time at (206) 296-9070 or by e-mail at david.seaver@kingcounty.gov.
Thank you very much for your consideration.
Sincerely,
David Seaver Senior Deputy Prosecuting Attorney Complex Prosecutions and Investigations Division Office of the King County Prosecuting Attorney (206) 296-9070 david.seaver@kingcounty.gov
To Whom It May Concern:
I am writing in support of the petition of Ron Belec, Michael Creel, and Marcia Smith for a civil order of protection against Julian Cauvin.Mr. Cauvin is currently the subject of a criminal action filed in King County Superior Court (cause no. 08-1-11633-2 SEA).I am the deputy prosecutor assigned to this case.
It is anticipated that Ms. Smith will be needed to testify in the trial that may occur in the coming months in the above-referenced action.Mr. Belec and Mr. Creel have provided useful information regarding Mr. Cauvin's actions and behaviors.
Ms. Smith, Mr. Belec, and Mr. Creel have reported to me that they believe they have recently been subjected to harassment by Mr. Cauvin, and their reports to me bear the ring of truth, though further investigation is warranted before additional criminal charges are filed.
I believe it is appropriate, under these circumstances, for a civil order of protection to be granted to them.It is my hope that such an order would discourage Mr. Cauvin from engaging in any further acts against these individuals, would provide them with some well-deserved peace of mind, and would allow the justice system to move forward on the above-entitled action more effectively and efficiently.
If you have any questions or concerns, please feel free to contact me at (206) 296-9010 or by e-mail at david.seaver@kingcounty.gov.Thank you for your consideration.
